1. About these terms
These Terms govern your access to and use of VetAss (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using VetAss on behalf of a Registered Training Organisation (RTO) or other organisation, you confirm you are authorised to bind that organisation, and “you” means both you and that organisation.
2. Definitions
- Assessor — an individual who holds the credentials required under the 2025 Standards for RTOs to make assessment judgements.
- RTO — a Registered Training Organisation regulated under the National Vocational Education and Training Regulator Act 2011 (Cth).
- Submission — student assessment evidence (e.g. PDF files) you upload to the Service.
- Suggested Outcome — the advisory result the Service generates for an assessment (Satisfactory, Re-assessment, Not Satisfactory, or Pending Review), together with any confidence note and feedback.
- Credit — a prepaid unit consumed to process one assessment.
3. What VetAss is — and is not
3.1 VetAss is a software decision-support tool. It reads each Submission and generates a Suggested Outcome to assist a qualified Assessor.
3.2 VetAss does not make assessment judgements or competency determinations. Under the 2025 Standards for RTOs, an assessment judgement may only be made by a credentialed Assessor. Suggested Outcomes are advisory only. The Service cannot and does not finalise any assessment.
3.3 You and your RTO remain solely responsible for: the assessment decision; exercising independent professional judgement; compliance with the 2025 Standards for RTOs, the Principles of Assessment and the Rules of Evidence; satisfying yourselves as to the authenticity of each Submission (whether it is the student’s own work, which VetAss cannot verify); validation; and all record-keeping and certification obligations.
3.4 VetAss is provided by Ardenna Pty Ltd. It is not a Registered Training Organisation, is not regulated by ASQA, and does not issue or contribute to AQF certification documentation.
4. No warranty as to accuracy
4.1 Suggested Outcomes are generated using artificial intelligence and may be incomplete, inconsistent, or incorrect. We do not warrant that any Suggested Outcome is accurate, reliable, or fit for any particular assessment decision.
4.2 You must independently review every Suggested Outcome and must not rely on the Service as the sole basis for any assessment decision. Over-reliance on the Service may compromise the validity and reliability of your assessment and is your responsibility.
5. Your obligations and warranties
You warrant that, for every Submission you upload, you:
- are authorised by the relevant RTO to use the Service and to upload the Submission;
- have the right, and have obtained or given all necessary consents and notifications (including to students, who may be minors), to upload student personal information to the Service and to have it processed as described in the Privacy Policy, including processing by our AI sub-processor;
- will provide students with any notice required regarding the use of automated tools in assessment; and
- will use the Service lawfully and only for legitimate VET assessment purposes.
6. Credits, payment and refunds
6.1 The Service is prepaid via Credit packs. One Credit processes one assessment, regardless of how many parts it contains.
6.2 Payment is processed by Stripe as a one-off transaction. We do not store your card details. Prices are in Australian dollars (AUD). [GST treatment to be confirmed.]
6.3 Credits do not expire. Credits have no cash value and are non-transferable.
6.4 If an assessment fails to process, the Credit is automatically returned to your balance. Except as required by law (including the Australian Consumer Law), Credit purchases are otherwise non-refundable.
7. Data and privacy
7.1 Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.
7.2 As between you and us, you (and/or your RTO) are responsible for the student personal information in Submissions and determine the purpose of its collection. We process it on your behalf and on your instruction to provide the Service.
7.3 Submissions are processed and then deleted; reports and identifiable results are automatically deleted within 24 hours of submission. We retain only de-identified, aggregate operational data and account/billing records as described in the Privacy Policy.
8. Intellectual property
8.1 We and our licensors own all rights in the VetAss platform. You receive a limited, non-exclusive, non-transferable right to use the Service.
8.2 You retain all rights in your Submissions. You grant us a limited licence to process them solely to provide the Service.
9. Acceptable use
You must not misuse the Service, attempt to reverse-engineer it, upload unlawful content, or use it to make assessment decisions without independent professional review.
10. Liability
10.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
10.2 To the maximum extent permitted by law: (a) the Service is provided “as is”; (b) we are not liable for any assessment decision you make, or for any consequence of your reliance on a Suggested Outcome; and (c) we are not liable for indirect, special or consequential loss.
10.3 To the extent we may limit liability, our total aggregate liability is limited to the total amount you paid for Credits in the 12 months before the relevant claim. Where a consumer guarantee applies and the law permits, our liability is limited to resupplying the Service or paying the cost of resupply.
10.4 You indemnify us against claims arising from your breach of clause 5 (including unauthorised upload of student personal information) or your assessment decisions.
11. Availability, suspension and termination
11.1 We aim to keep the Service available but do not guarantee uninterrupted access.
11.2 We may suspend or terminate access for breach of these Terms. You may stop using the Service at any time. Unused Credits are handled per clause 6.
12. Changes
We may update these Terms; material changes will be notified. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of [State/Territory], Australia, and you submit to the courts of that jurisdiction.
